1. Agreement to Terms

By registering an account with Vyam ERP, launching a gym website, or checking in as a member, you agree to comply with and be bound by these Terms of Service. If you do not agree, you must immediately cease using the platform.

2. Account Registration and Responsibilities

To utilize Vyam ERP management services, you must register a valid user account. You are responsible for keeping your login credentials secure. You are liable for all actions taken under your account. Gym owners must ensure that data entered regarding staff and members is accurate and obtained with appropriate consent.

3. Subscriptions, Payments & Limits

Vyam ERP is offered as a SaaS product with tiered licensing packages (Basic, Standard, Premium):

  • Billing: Fees are billed on a recurring annual subscription cycle unless stated otherwise.
  • Limits: Gym owners agree to stay within the bounds of their package limits, including member counts, staff accounts, and location settings.
  • Refunds: Payments are non-refundable except where required by specific service level agreements or standard platform cancellation policies.

4. Intellectual Property

All platform source code, system designs, logo components, dashboards, and templates provided by Vyam ERP are the exclusive intellectual property of Vyam ERP. Gym owners retain the rights to the branding assets, logo designs, and specific text content they upload to customize their branded sites.

5. Limitation of Liability

Vyam ERP is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, express or implied. To the maximum extent permitted by law in Nepal, Vyam ERP shall not be liable for any indirect, incidental, or consequential damages (including loss of business data, revenue, or membership dropouts) arising from service interruptions or system modifications.

6. Termination of Service

We reserve the right to suspend or terminate accounts that breach these terms, are involved in illegal activity, or fail to pay subscription invoices. Gym owners can request cancellation of their subscriptions through the dashboard panel at any time.
